Terms and Conditions of Online Sale

These Terms and Conditions apply to purchases made on BAKOBA.com. Please read them before placing an order. When you complete an order, you accept the Terms and Conditions that apply at the time of purchase.

1. General information

BAKOBA.com is operated by BAKOBA TOYS ApS, trading as BAKOBA.

For business customers, institutions, distributors and other B2B customers, any individually agreed written terms, quotations or freight approvals may supplement these Terms and Conditions.

2. Payment

We accept the following payment methods: Mastercard, Maestro, Visa, Visa Electron, PayPal, Apple Pay, Google Pay and bank transfer.

All prices, applicable VAT, delivery costs and any selected delivery options are shown in the checkout before you confirm your order.

Reservation of amount

If you pay with an international payment card, the amount may be reserved immediately on your card or account. The amount remains reserved until:

  1. we charge the amount when the goods are dispatched; or
  2. the amount is released according to the terms agreed with your card issuer.

You can read more about the reservation rules for your specific card from your card issuer.

We do not charge card fees. The amount is charged to your card only when the goods are dispatched.

If you pay by bank transfer, you are not protected by the Danish card chargeback/objection scheme. If you pay via PayPal, you are not protected by the Danish card chargeback/objection scheme; PayPal’s own terms may apply.

3. Shipping and delivery

We ship orders from our warehouse in Denmark. Orders are normally dispatched within 3 business days, unless otherwise stated on the product page, in the checkout or agreed with you in writing.

Standard shipments are sent as parcel shipments with tracking information. For larger orders, products may be shipped as pallet freight by agreement.

The expected delivery time depends on the destination and delivery method and will be shown during checkout where available. Depending on the carrier and destination, delivery may be made to a parcel shop or pick-up point close to the requested delivery address.

If you need express shipping, please contact us at cs@bakoba.com before placing your order, so we can advise you about available options.

For B2B customers, institutions, distributors and other business customers, we may send a freight estimate for your approval before the order is concluded and processed.

For deliveries outside the EU, local customs duties, import VAT, taxes and handling fees may apply. Such costs are the customer’s responsibility unless otherwise expressly stated or required by mandatory law.

4. Right of withdrawal

If you are a consumer, you have a 14-day right of withdrawal when you shop with us.

The withdrawal period expires 14 days after the day on which you or a person chosen by you, other than the carrier, receives the goods.

If you ordered several items in one order and they are delivered separately, the withdrawal period expires 14 days after the day on which you receive the last item. If an order consists of several lots or parts, the withdrawal period expires 14 days after the day on which you receive the last lot or part.

For agreements for regular delivery of goods over a defined period, the withdrawal period expires 14 days after the day on which you receive the first item.

To exercise the right of withdrawal, you must inform us within the withdrawal period that you wish to withdraw from your purchase. You can contact us at cs@bakoba.com or use the standard withdrawal form at the end of these Terms and Conditions.

If you use the digital withdrawal function, we will send you a confirmation of receipt without undue delay. The confirmation will state the content of your withdrawal notice as well as the date and time of submission.

You cannot withdraw from the purchase simply by refusing to receive the goods without also notifying us clearly that you wish to withdraw.

5. Withdrawal from part of a purchase

If you have purchased several items from us, you may return one or more items, even if they were purchased in one order.

Please note that delivery costs are not refunded if you withdraw from only part of your purchase, unless we expressly agree otherwise or mandatory law requires otherwise.

6. Returning goods after withdrawal

When you have informed us that you wish to withdraw from your purchase, you have 14 days to send the goods back to us.

You must pay the cost of returning the goods, and you are responsible for the goods if they are damaged during return transport. Please keep your proof of dispatch until the return has been processed.

BAKOBA products are normally returned by ordinary parcel shipment. Return costs depend on your location, the carrier and the size and weight of the parcel. We recommend checking the expected return cost before completing your purchase.

Returns must be sent directly to the address below. We only accept parcels sent directly to the address and do not collect parcels from parcel shops, pick-up points or similar locations.

7. Exceptions to the right of withdrawal

For standard BAKOBA products, the statutory consumer right of withdrawal applies as described above.

The statutory exceptions under Danish law may apply in special cases, for example if a product is manufactured to your specifications or has been clearly personalised. If a product is not covered by the statutory right of withdrawal, this will be stated clearly before purchase.

8. Condition of the goods when returned

You are liable for any decrease in the value of the goods caused by handling them in a way other than what was necessary to establish the nature, characteristics and functioning of the goods.

If the goods have lost value because they have been used beyond what is necessary to inspect them, we may deduct the decrease in value from the refund. In some cases, this may mean that you receive only part of the purchase amount back.

We recommend that you return the goods in the original packaging. Missing or damaged original packaging may, depending on the circumstances, reduce the commercial value of the goods.

9. Refund of the purchase amount

If you withdraw from your purchase, we will refund the payments received from you for the returned goods. If the goods have decreased in value due to handling for which you are liable, we will deduct the relevant amount from the refund.

For customers outside the EU/EEA, we refund the payment received for the returned goods only. Original delivery costs, return shipping costs, customs duties, import VAT, brokerage fees and other local charges are not refunded, unless mandatory consumer protection legislation applicable to the purchase requires otherwise.

For consumers within the EU/EEA, where mandatory consumer legislation applies, we will refund all payments received from you for the withdrawn purchase, including the cost of our least expensive standard delivery option. However, we do not refund any additional delivery costs if you selected a delivery method that is more expensive than our standard delivery option, such as express delivery.

Refunds will be made without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal. We may withhold the refund until we have received the returned goods.

The refund will be made using the same payment method that you used for the original transaction, unless we have expressly agreed otherwise.

Return shipping costs are paid by you, unless otherwise required by mandatory law or expressly agreed with us.

10. Right of withdrawal for business purchases

The statutory consumer right of withdrawal applies only to consumers. Unless expressly agreed in writing, B2B customers, institutions, distributors and other business customers do not have a statutory or contractual right of withdrawal.

For B2B shipments, we may submit a freight estimate for the customer’s approval before the order is concluded and processed.

11. Complaints and statutory right to complain

When you shop with us as a consumer, the rules of the Danish Sale of Goods Act apply.

This means that you have a 24-month statutory right to complain about defects in the goods. If your complaint is justified, you may be entitled to have the goods repaired, replaced, refunded or reduced in price, depending on the specific situation.

You must make your complaint within a reasonable time after discovering the defect. If you complain within two months after discovering the defect, the complaint will always be considered timely.

If your complaint is justified, we will refund your reasonable return shipping costs. The goods must always be returned in proper packaging. Please obtain a receipt for dispatch so we can refund your shipping costs where relevant.

We only accept parcels sent directly to the address. When returning goods in connection with a complaint, please include a detailed description of the problem and, where possible, your order number and contact details.

If you are acting as a business customer, we reserve the right to remedy a defect, for example by repair, before offering replacement or other remedies, unless otherwise agreed or required by mandatory law.

12. Complaint access and dispute resolution

If you are a consumer and wish to complain about your purchase, please contact us first at cs@bakoba.com so we can try to find a solution.

If we cannot find a solution, you may submit a complaint to Nævnenes Hus via the Danish public consumer complaints system. The relevant bodies are the Danish Mediation Team for Consumer Complaints and, if necessary, the Consumer Complaints Board.

Complaints are submitted through the Complaints Portal for Nævnenes Hus. Nævnenes Hus can be contacted at Toldboden 2, 8800 Viborg, Denmark.

For most goods and services, the item or service must generally have cost at least DKK 1,220 and no more than DKK 100,000 for a complaint to be processed. A fee may apply. These thresholds and fees may change, so please check the complaints portal before submitting a complaint.

If you live in another EU country, you may seek guidance through your national European Consumer Centre or the European Commission’s information on Consumer Redress in the EU. The former EU Online Dispute Resolution platform is no longer available.

13. Privacy policy

When you shop with us, we need the following information: name, address, telephone number, email address, order details and information necessary to ship and deliver the goods.

We register and disclose the personal data that is necessary to process your order, receive payment and deliver the goods to you. This may include disclosing relevant delivery information to carriers, fulfilment partners, payment providers and other service providers that help us operate BAKOBA.com.

Personal data is registered by Minitutor ApS, trading as BAKOBA, and is stored for five years, after which the information is deleted, unless we are required or permitted by law to keep it for a longer period.

We also cooperate with other companies that store and process data on our behalf. These companies process information only on our instructions and may not use it for their own purposes.

We cooperate only with data processors in the EU/EEA or in countries that can provide adequate protection for your information, or where another valid legal transfer basis is in place.

The data controller for BAKOBA.com is Minitutor ApS, trading as BAKOBA.

You have the right to know what personal data we process about you. If you believe the information is inaccurate, you have the right to have it corrected. In some cases, we are obliged to delete your personal data if you request it, for example if the data is no longer necessary for the purpose for which it was collected.
